I’m going to marry my boyfriend and I want to fix his papers

Answered by attorney Renea Overstreet
Immigration lawyer at The Overstreet Law Firm
After you get married, you should file the I-130 with USCIS and then your husband will be able to file the I-485 through the Department of State and go through the consular process to get his green card.

What happens to the foreigner after you withdraw a petition?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Assuming that the I-485 application is still pending at the time that you withdraw the I-130 petition, your husband would no longer have a basis to immigrate based upon his relationship to you. USCIS would not deport such a person immediately – it would in all probability refer his case to the immigration court. Because of the backlog in the courts, he could conceivably remain in the US for years if he has any defenses or reliefs that he can present to the immigration judge. Is my priority date current?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Unfortunately, your priority date is not current. Being exactly on the date does not make your immigrant visa available. Only a date earlier than the date on the chart qualifies. Thus, if the visa bulletin date was October 16, 2012, you would be current. You will have to wait a little longer.
