You can certainly file the visa petition and it can be approved notwithstanding his criminal record. It is the steps that follow after approval of the visa petition where his crimes come into play and might (or might not) bar him from immigrating.

Yes you need to start before the end of the 5th year (counting H-1B and L time) and be sure to allow enough time for recruitment before you file so figure at year 4 and ? to start the green card at the latest (You are allowed to start sooner if your employer is willing.)
