While there would not be a violation of status for an F-1 student on OPT to start a small business, it would be a violation of status for that individual to work in the business. You don't indicate if you have filed a petition for him, if you are a citizen or resident of the US, if he is in the US at the present, and when and how he was deported.

It really depends on the Service Censer where the applications were filed. Please look in USCIS.gov for processing times. In Florida, however, that is using the Texas Service Center; the receipts arrive in 2-3 weeks, the biometrics 2 weeks later, the work authorization in 90 days from the date of submission, and the interview in 4-6 months from the receipt date.
