Your daughter may qualify as a derivative beneficiary of your husband's application for you in the Immediate Relative visa category, and that process does require a separate Adjustment of Status application for the child. For a process this important, especially where you are not thoroughly familiar with the legal requirements, it would be wise to work with an immigration attorney.

Hello Jeff, Your wife is able to continue her work as an aupair so long as it meets the requirements set forth in her DS-2019 and her most recently issued I-94.  If she is eligible for adjustment of status then she may also apply for a work permit while her adjustment of status case is pending.  It typically takes about 6 months to receive the work permit through adjustment of status. Some misdemeanor offenses under state law are treated by the USCIS as disqualifying non-misdemeanors under immigration law, and some dismissals after deferred judgment and completion of probation are considered to be the equivalent of convictions under immigration law. There really is no substitute for having an immigration attorney review all of the documents relating to the arrest in order to provide appropriate analysis and advice.
