A U.S. citizen generally is able to apply for a spouse and children for immigration benefits, and this is true regardless of whether the U.S. citizen may have a felony conviction record, and regardless of whether the U.S. citizen is employed (if the U.S. citizen does not have sufficient documentable income, however, it may be necessary to include a "joint sponsor" in the application process. It would be wise to consult with an immigration attorney who, after learning all of the relevant information about you, your wife, your children, their immigration-related history, your marriage, etc., would be able to advise about eligibilities, options and strategies and would be able to offer legal representation for the application processes. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

Of course, there are many other details that impact eligibility. It would be wise for you and your mother to consult with an immigration attorney about eligibilities, options and strategies, and if applicable, steps that might be taken to become prepared for filing an application the moment you become 21 years old.
