What are my options if my marriage is suspected to be fraudulent?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Why is your marriage suspected of being fraudulent? Have you received anything in writing from USCIS regarding this? I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

US citizen married Japanese citizen, live in japan but want to move to US can we visit US while waiting for I-130? How long can Japanese husband stay.

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
While there is no prohibition against those who have visa petitions filed on their behalf from visiting the US during the pendency of the I-130 petition and related consular processing, the rule of thumb is that visits should be short and there should be convincing evidence that the individual will return to the home country at the end of the period of visit. A good example could be a person with a round-trip ticket to stay in the US for one month and then not return to the US for at least another 4-6 months. Current processing is approximately a year for your husband to immigrate to the US. He has no special privilege by being a Japanese citizen. What does EOIR29 NOTICE OF APPEAL FROM DECISION OF DISTRICT DIRECTOR, was reopened indicate?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
The notice you received means that BIA agreed with you and sent your case back to the Citizenship & Immigration Service for reconsideration. At this point, USCIS might approve your case. Or it might deny it, again, with a different reasoning. Adjudication of I-130-based applications for adjustment of status often turns on technical details; and providing an additional document or submitting a short legal brief can make the difference between approval and denial. Get a competent immigration attorney to review your case and submit to USCIS any papers he/she would deem necessary. At this point, it should not be too expensive - and worth every penny by lessening the risk of a new denial, with the aggravation and the expenses of a new appeal to the BIA.
