You can file for divorce or annulment of your marriage (if you qualify for the annulment). Even if you do not do that, you are not required to file any immigration paperwork for your husband. He will basically become an illegal immigrant at that point, but you probably signed an affidavit of support when you brought him here on a K1 visa, so you may be required to provide that poverty-level financial support to him because, when you brought him here, you agreed to be responsible for him, and the fact that he has changed does not play a role in this, unfortunately.

A person with a valid EAD to 12/2015, and with an expired visa and an unexpired I-94, is normally fully eligible to work through the EAD expiration date.

How can I find out if my common law husband will ever be able to be here legally? He was deported and came back illegaly.

This Immigration and Nationality Act Section 212(a)(9)(A)(ii)(II) basically makes your husband inadmissible for 10 years.  If he is deported a second time (because he gets caught in the US) he is inadmissible for 20 years.  If the crime that made him deportable in the first place was considered an "aggravated felony" under immigration law, your husband is inadmissable forever. If the criminal conviction can be challenged, your husband may be able to reopen his immigration case, but that would be a long shot (and it would be expensive).
