Complex Commercial Litigation: Representation of an African oil company against a major national oil company and a foreign government in breach of contract and tortuous interference claims seeking damages and rights to oil reserves valued at over $500 million. Defense of the founder of Houston-based energy brokerage company facing claims by a former partner of breach of fiduciary duty, breach of contract, tortuous interference, oppression and conspiracy. All claims were dismissed against the founder and his company following Moulton's argument on summary judgment. Representation of a worldwide manufacturer and supplier of marine and protective coatings in a breach of contract/construction dispute involving a $4.6 billion steel processing facility in Alabama. Defense of a prestigious Houston real estate firm in a $1.3 million commercial lease dispute. Confidential settlement on behalf of Cornerstone Orthopedic Hospital arising out of claims against Columbia/HCA Healthcare Corporation for tortuous interference with the construction of a specialty orthopedic hospital in Edinburg, Texas. In state and federal courts throughout the State Moulton represents departing brokers, physicians, partners, shareholders and employees in claims involving allegations of improper solicitation of clients, breach of contract, misuse of alleged confidential and trade secret information, breach of fiduciary duty, or tortuous interference, and seeking immediate and permanent injunctive relief and damages. On behalf of Hempel A/S and Hempel (USA), Inc., worldwide manufacturers and distributors of marine and industrial paints, Moulton has successfully handled, in jurisdictions throughout the country, an international arbitration, product liability claims seeking tens of millions of dollars in damages, employment disputes, and international payment disputes. In expedited proceedings, Moulton has arrested vessels in domestic and international waters, having once arrested the ship that discovered the Titanic wreck. Moulton also counsels the companies in legal matters generally.; Securities Arbitration and Litigation: Representation of a family limited partnership in a $5 million breach of contract/breach of fiduciary claim arising out of an investment in a real estate limited partnership. Successful defense of investors in Stanford International Bank certificates of deposit on claw-back claims brought by the Receiver. Breach of contract, breach of fiduciary and fraud cases on behalf of approximately 1,000 individuals who invested over $100 million in fraudulent vertical investments.; FINRA Arbitrations: Multiple FINRA arbitrations on behalf of investors in sophisticated options trading strategy who suffered losses of over $20 million. Confidential settlement of multiple FINRA arbitrations on behalf of over 200 clients with losses of over $60 million arising out of investments in real estate limited partnerships. In arbitrations nationwide, Moulton represents a major brokerage firm, or brokers employed by it and sued by their former employers, in claims alleging Raiding, improper solicitation of clients, breach of contract, misuse of alleged confidential and trade secret information, or tortuous interference, and seeking immediate and permanent injunctive relief and damages.; Personal Injury: $2,000,000 verdict in Hidalgo County on behalf of the family of Gloria Vera who developed stage IV pressure ulcers while a patient at McAllen Medical Center, resulting in her death. Confidential settlement on behalf of the family of Lucille Adcock who developed a stage IV sacral pressure ulcer while a patient at Park Place Manor Nursing Home. Confidential settlement with Ford Motor Company and Bridgestone/Firestone Inc. on behalf of a client who suffered serious injuries and the death of his wife when the Ford Explorer in which they were driving rolled over following the tread separation of a Firestone tire.; Appeals: Successful defense of investors in Stanford International Bank certificates of deposit on claw-back claims brought by the Receiver.
