Case Result: Trojan Boat Co. v. James S. Bolton, et al.

    Court: Maryl
    Court of Special Appeals

    Citation: 53 Md. App. 375, 453 A.2d 1230 (1982)

Practice Area: Workers' Compensation / Admiralty & Maritime Law

Case Summary: Barry Chasen successfully represented the claimant in a pivotal appellate case involving the jurisdiction of the Maryl
Workers' Compensation Commission. The primary issue was whether an employee injured while working on a vessel in navigable waters could seek benefits under the Maryl
Workers' Compensation Act, despite also being eligible for benefits under the federal Longshoremen's
    Harbor Workers' Compensation Act (LHWCA).

Legal Impact: The Court of Special Appeals ruled in favor of Mr. Chasen’s client, affirming that the state of Maryl
has "concurrent jurisdiction" with the federal government in the "twilight zone" of maritime employment. This l
mark decision ensured that injured maritime workers in Maryl
have the right to pursue state workers' compensation benefits in addition to federal remedies, significantly exp
ing the protections available to employees injured on or near the water.
