For instance, in Indiana, a will does not need to be notarized at all, but must be witnessed by two disinterested persons in the presence of each other at the time that the will is signed. However, your state may have different rules. You should consult with an estate planning attorney in the state in which the will was executed to be certain.

On his death, the debt of your father would pass to his estate. If his life insurance is payable to a specific beneficiary or beneficiaries it would pass directly to the beneficiary and would not be subject to the claims of creditors.
