The answer to your question depends on whether or not your father left a will or a trust. If he did not, and there was no surviving spouse, you would have certain rights under the law to a portion of your father's estate, and perhaps even all of it. In such a case, you would have recourse against your uncle and your father's girlfriend for taking the property. You should consult with an attorney experienced in probate matters as soon as possible to discuss the details.

If that is all your son left, you may not need to go to court but you will need to file a Small Estate Affidavit, wait for the judge's signature and find a bank which will accept it.  In any event, we have had independent administrations in Texas since 1843.  Probate here is neither as expensive nor as time consuming as you may imagine.

Yes, if your father does not have a Will appointing an executor or if none of the appointed executors want to be appointed, you can petition the court where your father's property is located to have yourself appointed as administrator of the estate. The Court will make you post a bond in the amount of the value of the property. The premium for the bond can be paid from the property in your father's estate.
