Can I access my father's medical records even if I do not have power of attorney?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
A power of attorney would not help. It dies with the maker. You may need to go into probate court, open a case by filing a petition to get a court order to access medical records. I suggest you speak with an attorney about the specifics before embarking on this path. Best of luck to you.

What should I do when my step brother sells a piece of land that is still in my father's name?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
It is not possible to legally sell land in someone else's name without being the trustee of a trust or through probate. Sit down with a probate and estate attorney ASAP to see what is going on. Do not wait because if he sold it privately to someone who didn't know better, there may be nothing you can do but get your share of the money and if your brother was willing to do what you say, he will either spend or hide the money from you. Call an attorney ASAP.

Can I still receive my share of money from a Will?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
If the will was probated and the estate closed, no. If the will was never probated, it is certainly possible if there is any money left to get after 12 years. Don't wait another 12 years, sit down with an attorney as soon as possible to discuss your situation and see what if anything can be done.
