Deed

Answered by attorney Dina Arvanitakis
Estate Planning lawyer at Arvanitakis Law Group, LLC
Your brother can add you on the deed either as tenants in common or tenants in common with rights of survivorship. However, if he adds you on the deed now, the property appraiser will increase the property taxes because there will be a new change of ownership because you were added to the deed. Property taxes will be re-assessed. What is your brother's objective to putting you on the deed? If it is to avoid probate, then he can do a lady bird deed and name you as a remainder interest. Ownership of the house will pass to you only if your brother predeceases you.

I have a trust but would like to make some changes, can this be done?

You need to schedule a consultation with an attorney who will review your trust in advance and advise you on your ability to change/amend all or part of the trust.

What happens to the house if I die?

Answered by attorney Thomas Corcoran Phipps (Unclaimed Profile)
Estate Planning lawyer at Law Offices of Thomas Corcoran Phipps
If the house is titled in your name only, it will go to the persons you name in your will. If you don't have a will, it will be distributed according to state statutes.
