I'm sorry to learn of your situation. Make sure of the following: 1. You personally did not guarantee the payment of his medical bills 2. The life insurance policy has you listed as a beneficiary. 3. Your spouse has appropriate Medicaid protection planning in place 4. Your spouse has an estate plan in place.

Your sister has no legal obligation to inform you of anything.  If there was no Will and you were an heir under Texas law, the attorney of the person applying to probate the estate would have sent you a Distributee's Agreement.  If there was a Will and you were a named beneficiary, the attorney for the person whom the Will appointed and the Court named as executor of the Will and estate would have sent you a Notice to Beneficiary after the Court admitted the Will to probate.  Based on your description, it appears that there was a Will and that you were not named as a beneficiary.

It depends on what the "taking" was and who did the "taking". An estate is a person like any other. The representative of the estate can take any action that would appropriate in a circumstance that did not involve an estate. Do criminal charges need to be filed? Does a demand letter preparing for a lawsuit need to be sent? How would you handle it if your money had been taken? If the "taking" was performed by the representative, action in the court appointing the representative should handle it.
