If your mother and her husband agree, they can retitle the property and provide in her will or trust for it to go the way she wants. If they don't agree, your mother can sever the joint tenancy (assuming it is in joint tenancy) by deed. Her husband then would have only half ownership of the property after your mother's death.

You could find a geriatric care consultant, and see if there are less expensive alternatives for care which would still provide the level of care your mother requires, but at a lesser cost. But your Mom needs the care she needs, and if that's how her money has to be spent, then that's the way it is.

The asset will need to be probated. Unless you disclaim your interest by signing a disclaimer or sign a consent to alternate distribution whereby you agree he will receive your interest, you will receive interest in the home or estate, assuming there are two children.
