What can we do if my aunt died and the funeral policy must be signed by her sister who is in a coma?

Answered by attorney Bernard H. Greenberg

The lawyer for your Aunt's estate should be able to resolve this and have the funeral policy apply to the funeral home's charges.

Yes, in Florida if a person is survived by a spouse, the spouse gets to keep the first $20,000 in household property and up to 2 cars. However, there is an exception if the item(s) was specifically bequeathed to someone else in the will.

What do I have to sign to use power of attorney?

You don't have to do anything. If you want to sign their checks, just bring the POA to their bank. If you want to make trades on their broker accounts, just notify their broker and send him a copy. If your parents are competent, you ought to alert them what you are doing. Keep in mind you are a fiduciary and everything you do has to be for their benefit or you could wind up with legal problems.
