Is there anything legal that can be done if the executor won't change their mind?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
You can go to court and advise the judge of these facts, get a report from a real estate agent, and ask the court to order them to fix the house.

What happens to settlement winnings if the person entitled to it dies?

Answered by attorney Christine James

The first lawyer is correct. It will got to his wife. Whether it will go through probate depends upon the state where your brother lived when he died and how much his share of the settlement is. At James Law Group we make every effort to respond to you quickly and efficiently. This means we may be responding to you from a mobile device. Can your legal fees be recovered in a contested Will case if you win in court?

Answered by attorney Brian Haggerty (Unclaimed Profile)
Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
You should ask the lawyer who is representing you in the will contest, and/or in the probate. There's too much not said in your question. Are you the personal representative named in the will? Have you petitioned the court for support as the widow? Have you petitioned for an elective share, if that applies? The PR's legal fees defending a will would normally be paid by the estate.
