If my husband died and left his house to his kids in a will, am I still entitled to half ownership of the house?

Melissa Ann Botting
Answered by attorney Melissa Ann Botting (Unclaimed Profile)
Estate Planning lawyer at Law Office of Melissa A. Botting
It depends on whether or not the house was separate property. He was entitled to bequeath his property to whomever he wanted. His will can only transfer his property. So, if the house was community property, he could not bequeath your half to anyone.

Issues regarding Estate and Affidavit of Heirship Recording

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
Hire a probate lawyer in the county in which your mother lived to file an Application for Determination of Heirship and Issuance of Letters of Administration.  If Florida law treats mineral rights as personal property, that should suffice.  If Florida law treats mineral rights as real property, after the Texas probate there will need to be an ancillary probate in Florida.

What do I do if my mother has passed without signing over a power of attorney?

A power of attorney ceases to be valid on the date of death. To manage your mother's estate, you would have to qualify as the Administrator of the estate.
