When someone says they have Power Of Attorney, should they have a document with the signature of the person they are making the decision for?

Answered by attorney David L. Leon
Estate Planning lawyer at David L. Leon, P.C.
The POA dies with the power grantor. The document needs to be signed by the power grantor and notarized. A witness is not necessary.

Do I have to leave each child something when I do my estate planning?

Nothing requires you to leave anything to any of your children in your will. You need to make your will absolutely crystal clear, however, that you do not intend to leave them anything. You would be wise to consult with an estate-planning lawyer as to how this can best be done.
