It is a crime to fail to file a will for probate. I couldn't guess what any particular attorney would charge. You should hire an attorney in the county where the mother resided at the time of her death.

Write out your wishes in your own writing, date it and sign it, and you are done. Make sure that everyone knows where to find your Will in the event of your death. (This is not the BEST way to make a Will.) It is the cheapest, however. An attorney can advise you as to whether there are better planning tools available for you. Many people prefer to avoid probate, for example, and you cannot do that with a Will.

If your father left a will, it should be filed in a probate court in the county in which he resided. If your stepmother hasn't done this, you can petition the court to name you executor of the estate and/or to require her to produce the will.
