There is no requirement that you open a probate case, even if there were assets. If the plot was owned just by your mother, only she would be capable of selling it. Florida law provides for abbreviated probate proceedings if need be to deal with estates with very little assets.

If you transfer your house to your husband (which is what he's talking about don't focus on the loan, focus on the ownership; and remember, the lender will only write a loan for the person or people who own the house) nothing happens when you die, because you don't own the house any more. Your husband could write a will leaving the house to your sons; he could also change his will or sell the house after you die. I cannot imagine that there are savings so substantial from refinancing that it is worth taking this risk.

Your brother can add you on the deed either as tenants in common or tenants in common with rights of survivorship. However, if he adds you on the deed now, the property appraiser will increase the property taxes because there will be a new change of ownership because you were added to the deed. Property taxes will be re-assessed. What is your brother's objective to putting you on the deed? If it is to avoid probate, then he can do a lady bird deed and name you as a remainder interest. Ownership of the house will pass to you only if your brother predeceases you.
