Since this matter arose in 2004, you ought to be concerned that any claim you may have for survivor's benefits could already have been lost due to a statute of limitations. You need to have your paperwork reviewed immediately by an attorney.

In Oregon, the lawyer who represents the personal representative has to apply to the probate court for approval of his fees, if he plans to be paid out of the estate. Some Oregon lawyers say it is okay to expect the personal representative to pay out of his pocket, but that probably should have been made clear up front. Look at the engagement letter that was presented at the beginning of the representation. Maybe suggest fee arbitration through the bar.

You do not say whether this was a lawsuit which was filed on behalf of your father before his death, in which case you should have done so under a Durable Power of Attorney; whether this is a wrongful death suit; or whether there is a dispute over his estate.  Without this information, it is hard to answer your implied question.
