Who has the legal rights to a deceased person's car?

James Brian Thomas
Answered by attorney James Brian Thomas (Unclaimed Profile)
Estate Planning lawyer at Burdette & Rice, PLLC
Sounds like a pretty open-and-shut case to me. I can't even begin to think of how a suit by your nephew could involve a vehicle that has not been used in 18 years. Even then, if your father has been sued, he needs to consider retaining a lawyer. At a minimum, the attorney could help your father timely file an Answer to the suit, assert any of a potential number of affirmative defenses and likely get the nephew's claims dismissed fairly quickly.

How much of her husband's estate and assets is a wife legally due when she dies?

Robert Neil Newton
Answered by attorney Robert Neil Newton (Unclaimed Profile)
Estate Planning lawyer at The Law Office of Robert Newton, P.C.
The signer of a will can only bequeath property that is owned by her at the time of death. They cannot transfer property of another. With that being said, there could be some contractual situations that arise, but that does not appear to be what you are describing.

Can I get control over my father's estate if I live in a different estate than he does?

Estate Planning lawyer at Candace K. Ladley, Attorney at Law
Yes, if your father does not have a Will appointing an executor or if none of the appointed executors want to be appointed, you can petition the court where your father's property is located to have yourself appointed as administrator of the estate. The Court will make you post a bond in the amount of the value of the property. The premium for the bond can be paid from the property in your father's estate.
