Without a will you have a right to 1/2 of his estate in most jurisdictions and your brother gets the other 1/2. Your aunt should get nothing. Call an attorney immediately and file a probate actions for your fathers estate to get everything back

The trust can only act through a trustee. Therefore, if there is a lawsuit filed, the trustee is the plaintiff bringing the action on behalf of the trust.

If title to the house is in the trust, and you are the TRUSTEE of the trust, no. But be sure you're fulfilling all your responsibilities as trustee. If title was merely in your mother's name, then yes, you presumably will need letters testamentary.
