How can we find out about government disbursement of mother's retirement?

Ian Alexis Heyman
Answered by attorney Ian Alexis Heyman (Unclaimed Profile)
Estate Planning lawyer at Arnold Clifford LLC
In order to determine whether additional benefits may be payable to your mother's estate, I recommend that the Executor of your mothers estate (or your lawyer) contact the human resource division of the specific government agency which your mother worked for. Ask to receive a copy of your mother's retirement benefits allocation, and review the terms of that retirement program. If your mother's former employer does not respond in a timely way, send them a formal request by certified mail, and engage a lawyer to accelerate the processing of your mother's Will and estate.

Do I have any rights to the home after my husband dies if my name is not on the title?

Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
Yes, but your rights are complicated, and both you and the kids would need to go through probate to get what is coming to you. That is not good for anybody. Your husband can easily take care of this situation, protect you and the kids, and make sure that none of you need to pay thousands of dollars to the court and attorneys. He should see an estate planning attorney and take care of this, as soon as possible.

Can anyone tell me if a revocation of advanced directive and durable power of attorney for health care revokes only for advance Health care directive?

Answered by attorney Victor L. Waid (Unclaimed Profile)
Estate Planning lawyer at Law Office of Victor Waid
Advance Healthcare directive is for the purpose of someone to manage your healthcare when you cannot. Durable Power of Attorney is for managing your financial affairs, when you cannot do so for yourself. In both documents, the same person may be named as the designated agent to carry out the specific needs of the maker of the directives. One could be revoked without the other, or amended, to name a different agent to exercise the directive/power. Two documents should have been prepared.
