Is a 5 day real estate offer to me in a memorandum a legal contract?

Answered by attorney Edward M Olson (Unclaimed Profile)
Estate Planning lawyer at Olson Law Firm
There is no way to provide a legal opinion without seeing the documents in question. However, it is possible that you have a contract which was breached. There are remedies available for breach of a real estate contract, including specific performance.. in other words.. forcing the sale to you. My recommendation is that you talk to an attorney as soon as possible to get the best result.

Is my mother entitled to receive that settlement now and in turn are we as children entitled to any of the money from that?

If this is a wrongful death case, then Michigan law has a procedure for claims made in the action and payment which supersedes simple probate law . It recognizes the claims of other family members. Now, how much, etc. is fact driven. But you should have received notice of a wrongful death matter. If it was not a wrongful death matter, then normal probate procedure would be followed and the court would typically be required to follow the dictates of the will.

Can I be told about my mother’s financial history after her demise?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
You need to see an attorney ASAP. Oldest doesn't trump FIRST. You need to be first to request legal authority to get access and control.
