Will my mom be able to inherit her stepfather's estate?

Richard Samuel Price
Answered by attorney Richard Samuel Price (Unclaimed Profile)
Estate Planning lawyer at Price Law Firm, APC
1.  California law does not provide for intestate succession for step-children that are not adopted, unless they couldn't adopt due to a legal barrier (a parent wouldn't give up parental rights).  But that legal barrier goes away when the step-children are over 18 years old. 2.  The law of the state where the decedent lived when he died contols.  So Alabama law would apply to this estate, not California law.  You should ask this question again under Alabama law.

How can land be divided up between family members when there isn’t a will?

default-avatar
Answered by attorney George Winslow Mead (Unclaimed Profile)
Estate Planning lawyer at Mead Smith P.C.
This issue would be covered by the laws of intestate succession of the state in which your great grandfather lived. So likely if he died widowed, the interest would pass to his kids, and then to their kids by either right of representation of per stirpes. You should definitely consult an estate planning lawyer.

Is it legal for my son to get me out of the house so they can sell it?

Estate Planning lawyer at Peters Law, PLLC
Not unless he goes to court and asks for the house to be sold. You have as much right to possession as he does.
