How to probate my mother's estate and what to do about the grandson living in her house?

Obtain the services of a probate lawyer to probate your mother's will, and have yourself appointed as the executor. If there is enough of an estate the lawyer is paid out of the estate.

This is a difficult situation. First advice is to get a lawyer of your own. The answers to your questions are complex. In order to probate a will, you have to have the original will, unless you can explain what happened to it. So, first, someone needs to evaluate on your behalf what the result is if there's no will, and what the result is under this will that's on disk. If you'd rather have the will, let them probate the copy; if not, then object to the probate of that will. Basically, you have to decide whether you will inherit enough to make this worth the fight; if yes, hire a lawyer.

Life insurance minor beneficiaries and divorce

If you expect the value of all your assets to be under $5,000,000 (including the face value of the life insurance policy) when you die, you probably will not need an irrevocable life insurance trust.  You might want to do a revocable trust, however, and name that trust as the beneficiary of your life insurance policy.  You can be trustee of that trust, and it is not a separate taxpayer (no income tax returns required) until you die.  If you are required to provide support under your divorce decree, you should check with your divorce lawyer on whether this complies with what you have been ordered to do.
