It depends on what the "taking" was and who did the "taking". An estate is a person like any other. The representative of the estate can take any action that would appropriate in a circumstance that did not involve an estate. Do criminal charges need to be filed? Does a demand letter preparing for a lawsuit need to be sent? How would you handle it if your money had been taken? If the "taking" was performed by the representative, action in the court appointing the representative should handle it.

The person named in father's will needs to petition the court to be appointed personal representative. Probate should be started in the county he called home, or where he had assets; if there is real property, there will have to be a probate in that state. Get a lawyer to help with this process. It is far less expensive to do it right from the beginning than to fix it after the fact.

It is not clear to me whether your parents created one will which they both were supposed to sign or two separate wills - one of each of them.  If it's the first RUN to a local estate planning attorney and get it done right.  If its the second and it was not done by an attorney, again RUN to a local estate planning attorney and get it done right.   Second you may be the named executor in the will, but you have absolutely no power to do anything until such time as the will is probated and you are appointed as executor by a probate court.   Finally, most attorney's who are estate planners can arrange for tghe appropriate people to assemble in hospitals or nursing homes to facilitate the execution of wills appropriately under Texas law.  It requires more than just signing it.
