Is a letter of administration as personal representative of deceased owner enough to evict the tenants?

Answered by attorney Bernard H. Greenberg
Estate Planning lawyer at Kokish & Goldmanis, P.C.
The Personal Representative of an estate, if duly appointed by the Court, has full authority to deal with all property owned by the estate. This would include the legal ability to lawfully evict tenants or occupants of property owned by the estate.

Yes. A handwritten will is effective under Michigan law. It is known as a "holographic" will. Having a witness helps.

Am I the sole owner of the house after their death?

Answered by attorney Carl C Silver (Unclaimed Profile)
Estate Planning lawyer at Carl C. Silver Attorney at Law
First you need to obtain a copy of the deed to the house from your county register of deeds office to determine if the house is deeded to the trust or to you and your parents as joint tenants. It can't be owned by both as implied by your question.
