How do I prove that my birth certificate is really mine if my adoptive parents changed my name through baptism?

default-avatar
Answered by attorney Victor L. Waid (Unclaimed Profile)
Estate Planning lawyer at Law Office of Victor Waid
I am assuming you have used the baptismal name almost all of your life, including establishing social security benefits, retirement, etc. That being said, you may want to legally change your name to your baptismal name, in other words confirming the name you have used for most of your life, unless you are expecting some big inheritance. To establish your baptismal name as your legal name, you are confirming all of your social and legal relationships, regardless of what your supposed birth certificate says.; therefore, suggest you obtain the services of a family law lawyer to file a petition to establish your legal name.

What are my rights to my father’s properties after he passed without a will but has given my sister the power of attorney?

default-avatar
Answered by attorney Richard Everett Damon (Unclaimed Profile)
Estate Planning lawyer at Richard E. Damon, P.C.
Uh oh. The power of attorney lapsed once your father passed, but actions your sister took pursuant to the power of attorney might be upheld by the court. Of course, the purpose of the power of attorney was to take care of your father's expenses, not to make gifts to your sister. You should consult an attorney about your rights.

What happens if my grandfather dies and my parents can't pay his home payment?

If your mother inherits real estate and cannot afford to keep it, then she should sell it. Also consider renting it out (if the rent will be sufficient).
