As executor, you are responsible for notifying all of your father's creditors and debtors of his death, collecting all of his assets and any money or goods owed to him, paying off all of his bills including end-of-life expenses and funeral expenses from the assets of the estate, determining and paying all taxes and estate taxes due also from assets in the estate, and then distributing the remaining assets according to the terms of his will. If your mother co-owned each of the accounts with your father, she is probably entitled to the money. If not, she will probably have to pay it back or accept it in exchange for something else she was bequeathed in the will. Most state grant surviving spouses a pre-set sum or percentage of an estate to help them pay bills, etc. until the estate is settled.

Girl friend is entitled to be on the deed if she is putting in money or sweat equity to build the house. Take title in joint tenancy, which gives either of you the right of right of survivorship. Your advised to seek the assistance of a real estate lawyer to advise the two of you.

A joint tenant's interest is subject to levy and execution. See McDowell v. Trailer Ranch, Inc., 421 So. 2d 751 (Fla. 4th D.C.A. 1982). Therefore, as a general rule where a certified copy of a judgment has been recorded against a joint tenant with right of survivorship, such judgment lien must be released or shown as an exception to coverage. One exception to the general rule exists. Since the interest of a joint tenant terminates upon his death, a lien on his interest is a lien on a defeasible interest. The lien terminates when, by reason of death, his interest in the tenancy terminates. See D.A.D., Inc. v. Moring, 218 So. 2d 451 (Fla. 4th DCA 1964). Therefore, where the joint tenant against whom a judgment lien exists dies and the property vests in the survivor, the judgment lien against the deceased tenant may be disregarded.
