You may need to petition the court for guardianship unless your mother voluntarily gives you a health care power of attorney. Be sure it has a mental health provision.

Maybe.  While most states respect a Will drafted in another state if it was properly drafted and executed under the laws of that state, Florida law may have benefits for you which were not available under the law of Rhode Island.  For example, you may be able to pass title to your home free of probate and free of Medicaid Estate Recovery in Florida.

Typically, if probate is required, creditors would learn of the death from a notice to creditors that has to be published in probate; some creditors get notified by the Clerk of the pending probate action. However, if the personal representative waits until two years from the decedent's death before probating the estate, then the creditors would be barred.
