How do I terminate a contract with a real estate broker about a private house?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
The contract may be non-revocable for the period of the listing, i.e. 90 days. You need to review the terms. If in doubt have an attorney review the contract and advise you on the same. The response to your inquiry does not create an attorney client privilege. The answer is merely based upon the facts presented and if you are unsure you should seek a consultation with qualified counsel to address your specific issues.

If my mother had a bank account and property, do her children get an equal share or one gets everything?

Answered by attorney David L. Leon
Estate Planning lawyer at David L. Leon, P.C.
Assuming mother didn't have a will, then the property would go under the Texas intestacy statute. Typically, the spouse would get a share (assuming there is a spouse), and then the children would get a share. I'm assuming mother didn't have any debts.

Is a life insurance policy discussed in a will?

Judith Navi Douglass
Answered by attorney Judith Navi Douglass (Unclaimed Profile)
Estate Planning lawyer at Douglass Law Group
A life insurance policy will pass to the beneficiary you have specifically designated, and will pass outside of probate. However, if there is no beneficiary designated or the beneficiaries you had named are no longer living, the estate is the beneficiary and it will have to go through probate.
