It sounds like she was not on the account. If not, it is technically theft. As the executor, you can move the court to force her to turn over all of the funds she received. However, is she entitled to anything under the will? If so, maybe you can just offset what she got against what she is supposed to get. You should contact a local probate attorney and go through the details of the situation with him or her.

Please contact a Florida probate attorney in the county in which your aunt held property and died.  It does not appear that you have any right to the property.  Do not spend money on the mortgage:  even if her son disclaims his inheritance, it will pass to his children, not to you.  You will have to file a claim against the estate and prove that this was a loan to the estate, not a gift.  Under most states' inheritance laws, nieces and nephews can only inherit if there are no children (or children of children who disclaim), parents, aunts or uncles.

You need to set up an appointment with an attorney. It is likely that the home was your mother's homestead. If so, you would need a court order that establishes that. The homestead passes by operation of law to your mother's heirs (likely you and your sister). If it is not homestead, the property will have to pass through her estate to you and your sister. In either case you will need an attorney to help you with this. Once the property is in your name and your sister's name, the credit union should be willing to deal with you.
