It doesn't matter who's named "on the will," the question is who was named by the Court to serve as personal representative. If two people are appointed Co-PRs, then both have to act unless one can claim an emergency, or that the other was unavailable. Signing a listing agreement to put the house on the market is easy, and realtors often don't pay much attention to the legal authority. It will get ugly when there's an offer to buy, and one co-PR can't bring the other to the table to complete the deal.

You should ask him if you can have a lawyer come and see him - prepare a will leaving everything to you. If all the property you own (real and personal) is jointly owned you will end up owning it completely on his death. Then you can have a will prepared and leave whatever you want to relatives of your choice.

Congress recently made permanent the exemptions to offset the estate tax, the gift tax and the generation skipping transfer taxes. If your mothers assets total less than $5 Million there won't be any federal estate tax. You might want to make sure that all of her assets are in her living trust or make sure that assets are held jointly with her children or are in a form that will "transfer on death" or "pay on death." This will reduce or eliminate the expenses associated with probate administration.
