Can we have their names removed off the property deed now that they are deceased?

All depends how the deed was worded.? If it says "joint with rights of survivorship" then yes. If not, then their estates each own an interest. If you have further questions, let me know.

What can I do to stop this ladybird deed?

Michael C Hyde

Obtain guardianship and conservatorship over your mother and then file a motion with the probate court to reform the deed. Or sell the home prior to your mother's passing.

What happen if the executor wants to take money out that is not in the will?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Estate Planning lawyer at Peters Law, PLLC
Well, is he taking it out to pay your father's bills? If so, then it is required, even if not in the will. If on the other hand, he is doing it for his own benefit or someone else's, you can go to court and ask for the court to order him to stop.
