What should I do if my trust that was left to me by my grandfather has been embezzled by two trustees and an attorney I hired?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Estate Planning lawyer at Peters Law, PLLC
You have to sue all three. And the attorney you hire will have to know who embezzled. If it is true, you might be able to go after the attorneys malpractice insurance. And do it now, before it is too late.

What rights do I have to my life partners estate? How?

Answered by attorney Jayne L. Sebby (Unclaimed Profile)
Estate Planning lawyer at Jayne L. Sebby
Very few states recognize "life partners" for the purposes of determining the distribution of an estate, whether the partners are of the same or opposite sex. However, I would hope that his mother would acknowledge this long term relationship and allow you a say in the distribution of his possessions. The things that you bought jointly should stay with you; however, the things he owned prior to becoming your partner may belong to her now. In any case, she has no right to enter your home without your permission.

Is it legal for my brother to make a document that gives him certain rights to the property?

Answered by attorney Yahima Suarez (Unclaimed Profile)
Estate Planning lawyer at Hernandez & Suarez, PL
If the document your brother has was executed as a last will and testament with all the requirements and formalities of a last will and testament and was executed last, that's the document that will prevail. However, just a simple document, although notarized but without the formalities of a will, will not supersede an existing Will.
