How can we get our money from our trustee who did not follow the trust?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
You really need to consult an attorney to address your options. In Nevada, you may choose to confirm the Trust with the probate court and require an accounting. Again, meet with an attorney who can review the trust and advise you on your rights.

What are my rights as the biological child if my father put everything he owed into his adopted kid's name?

Estate Planning lawyer at Douglas A. Tull, P.C. Attorney at Law
There is no "right" to inherit. However, if your father had not titled assets to his adopted son (who, legally is the same as the biological son), and your father died without a will saying who he wanted to get his assets, and he was not married, both of you would share the estate equally.

How do we sell the house before moving our Mom to assited living?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
You need to meet with an attorney to address these issues. This is a complex situation and a trap for the unwary. Your brother needs to get advice as soon as possible, but certainly before making any moves.
