What kind of lawyer specializes with estates and estate distribution?

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
If you are an heir or beneficiary, the probate lawyer has no obligation or right to share information with you.  You can see a copy of everything filed with the court by contacting the clerk of the probate court.  Many counties have these documents on line.  Please keep in mind that estates often are not distributed for over a year to allow for payment of the final federal income taxes and any other creditors.

In Indiana, if the 2010 Will is unsigned or not properly executed (in front of two witnesses) and the 2007 Will is signed and properly executed, then the Court will allow the 2007 Will to control.

What can we do to keep from paying all her money to the nursing home?

Estate Planning lawyer at Barron, Rosenberg, Mayoras & Mayoras, P.C.
Honestly this is what I do for a living. If your mother is married I can protect all of a married couples money except for possible income tax consequences on IRA's etc... As for a single person we can protect somewhere between 50% and 70% of the assets and accelerate Medicaid qualification. I need to know more about your situation. I have been doing this for 30 years and have never been denied a Medicaid application. Further, it is usually never too late to plan.
