How can I contest my sisters will who left all her personal property to the lady who was taking care of her?

Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
I do not believe there will be taxes on the personal property. If there are, then they would be paid by the estate. The grounds for contesting a Will are generally: 1) lack of proper execution, (such as failure to sign the Will, lack of witnesses, etc); 2) lack of capacity, (she did not understand what she was doing because she was incompetent); and 3) undue influence, (she had a gun to her heard, etc).

What could the executor have wanted my personal information for?

Answered by attorney Ronald K. Nims (Unclaimed Profile)
Estate Planning lawyer at Ronald K. Nims
The executor is required to report name, address and date of birth (or just "adult" if over 18) to the probate court of all the children of a deceased. Regardless of whether they will inherit under the will.

Is he able to cash out the 401k without my consent?

default-avatar
Answered by attorney Mark Schaefer (Unclaimed Profile)
Estate Planning lawyer at Elder Law Office of Mark Schaefer PC
I assume that "he" refers to your husband. The answer in that case is yes, he can roll his former employer's 401k into an IRA in his name. Once it is in the IRA, he can designate anyone as beneficiary. No spousal consent is required by most IRA custodians.
