Generally, real estate agents use a binding contract but contracts often have provisions that release a party. For example, very often real estate contracts provide that if the buyer can't get a loan, then they can walk away from the contract.

A power of attorney is void upon death. You need to see an attorney about opening up a probate estate so you can close out the bank account. You will need to be able to give the attorney a death certificate of your mother, the names and addresses of all her children, and the name of the bank, the bank account value, whether a checking or saving account and the account value.

It depends on how the will is drafted. It may specify what assets are subject to which liabilities. If not, by default the residue would be subject to debts before a specific devise.
