Can I designate to whom my children will live in a will? How?

Answered by attorney Jayne L. Sebby (Unclaimed Profile)
Estate Planning lawyer at Jayne L. Sebby
Absolutely. One of the main purposes of a will is to indicate who will become the guardian of any minor children. Your children's mother may object and petition a court for custody. So take that into consideration when you choose the guardian and provide plenty of documentation as to why the judge should follow your wishes.

How do I stop my sister from selling the house my 90-year-old mother is in?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Estate Planning lawyer at Peters Law, PLLC
You can petition for guardianship but must prove that your sister is abusing her position with your mother. She may be doing that, or she may be selling the house to come up with money to pay for your mother's care. There is no guarantee you will win.

Can we force the sale if one of the five does not want to sell?

Answered by attorney James E. Reed
Estate Planning lawyer at Vandervoort, Christ & Fisher, P.C.
The answer depends on how the property is titled and whether your father is still alive. I assume he is not. If not, then perhaps. If the Deed conveyed the property to A, B, and C, and didn't say anything further or stated "as tenants in common" or stated "as joint tenants," then either A, B, or C could file a partition action with the Circuit Court to force a sale of the property. If, however, the Deed conveyed the property to A, B, and C "as joint tenants with the full rights of survivorship," then, no. You can't do anything to force a sale.
