If you do a valid Estate Plan you can leave your estate to anyone you wish. You may also not to leave anything to certain children. If the you will be disinheriting certain children it is important to avoid both probate (no Living Trust) and intestate succession (no Will).

It may be customary for marital partners to arrange their financial affairs for the care and support of each other upon death. A trust, however, being one of several tools by which to do so, may direct that none of its assets be awarded to a spouse and that, upon her death, all of its assets be divided among his children only with nothing going to her children.

Every state has different rules on how wills are to be properly authenticated. For instance, in Indiana, a will does not need to be notarized at all, but must be witnessed by two disinterested persons in the presence of each other at the time that the will is signed. However, your state may have different rules. You should consult with an estate planning attorney in the state in which the will was executed to be certain.
