My two brothers and I made a verbal agreement we will take care of our elderly mother, who is diagnosed with Dementia five years ago..

I dont know if your mother has any assets ( home, pension plan, etc) but if she does, then maybe you and your siblings agree in writing that you will get a larger share of the remaining assets of her estate upon her passing to compensate you for the expenses incurred in caring for your mother. Since your mother has dementia, who has the power of attorney over her care and over her finances? Again, maybe you and your siblings can agree that you will be paid from her assets for the time spent and to be spent caring for her.

Will a life insurance policy taken out on me by my son be considered part of my estate.

No - it would not be part of your estate because your son will be the owner of the policy.  However, in New Jersey, the person buying and paying for the policy has to have an insurable interest in the person they want to insure.  In some states you can buy and insurance policy on another person with out any relationship or interest, but in New Jersey there has to be an insurable interest.

It is not possible to answer this based on the information given.  If you are trying to avoid estate taxes, the money will be drawn back into the estate, if the person dies within 3 years o the gift.  In order to avoid the taxes, the person must give up all indicia of ownership of the asset.  I prefer to let elderly people keep their assets to pay for their own care instead of worrying about taxes.  estate taxes will nt be inucrred unless the estate is over $675,000
