Can the unsigned will be admissible in probate court?

Answered by attorney Jayne L. Sebby (Unclaimed Profile)
Estate Planning lawyer at Jayne L. Sebby
An unsigned will is not valid. Without a will, the surviving spouse is usually the primary beneficiary of a deceased spouse although some state do split the estate with any children by birth or adoption. If there is no surviving spouse, state law will determine who gets what.

I am on SS disability and need to remove my sister from my special needs trust now and don't trust her how much does it cost?

Estate Planning lawyer at Gerald A. Bagazinski
You can petition the probate court for a Court Supervision and a change of Trustee. The judge will consider the matter if you have cause to remove your sister. An attorney may consider taking your case based on the facts and circumstances and look to the Court to direct the trustee to pay the attorney fees.

Is tangible personal property included in probate?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
All tangible and intangible assets will need to go through probate to transfer to another, absent a beneficiary or joint tenancy designation on an account or on title to property. If the assets total value is under $20,000 an affidavit may be used by the person entitled to receive the same, so long as no real property is involved. If the total assets value when added up are under $100,000 a set aside administration may be available. I urge you to speak with a probate attorney where the decent resided to determine the best course of action.
