Tough one; you might be able to get the insurance company to reissue the check in your name. Theoretically you should re-open probate, but the court fees are probably more than the refund.

Very tough issue. This is one of those areas where the personal representatives would have a fairly wide degree of discretion. You can complain to the probate court if you feel there is a breach of fiduciary duty, but this seems like an area where reasonable minds could easily differ. I would try to discuss this with them and see if there is some compromise you can agree on.
