What happens to my brother's share if he passed before distribution?

Answered by attorney Brian Haggerty (Unclaimed Profile)
Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
In Oregon, you'd have to analyze each step separately. Did the second of your parents to die have a will? Does it say how long a devisee has to survive in order to inherit? Did your brother survive long enough to take a share of parent's estate? If yes, and then brother dies without a will, and without children, then his wife inherits. Then she dies with no spouse and no children, so HER brothers and sisters inherit (assuming her parents are already gone). Specific facts in each case might change this analysis; but, basically, nothing to do but to take it step by step, estate by estate.

Can someone continue to live in a house that has a reverse mortgage after the legal owner is deceased?

For a little while. The mortgage company has a right to be paid; there are extensions of time that are available in some cases, but eventually the mortgage company will foreclose. If the house can be sold prior to that happening, you're probably better off.
