It is not possible to answer this based on the information given.  If you are trying to avoid estate taxes, the money will be drawn back into the estate, if the person dies within 3 years o the gift.  In order to avoid the taxes, the person must give up all indicia of ownership of the asset.  I prefer to let elderly people keep their assets to pay for their own care instead of worrying about taxes.  estate taxes will nt be inucrred unless the estate is over $675,000

you will not loose it to inheritance tax !  There is no inheritance between a parent to a child.  You may have to pay estate tax if the total amount of your parents estate is over $675,000.  there is a very easy way to double that, to protect $1,350,000.  You should explore various options, a trust for the house, taking advantage of all tax credits, and possibly gifting.  You can call my office for a free consultation.

She should hire a NJ estate lawyer. No, she should not be liable unless she co-signed. An estate may need to be opened. If there are insufficient assets of the husband to pay the debts, the court will discharge the claims.
