I believe that all states have statutes that govern the priority of creditors of an estate. Generally, the assets left behind must be used to pay off creditors, and then distributions made to heirs. In order to prove a will valid, it must be probated, and a good probate can help a lot. If you have specific questions, you need to see a probate lawyer who practices in the state where the deceased resided at the time of death.

When a Will is submitted for probate (proving that it is the Will of the person who died), it becomes a public document.  Check with the clerk of the probate or surrogate's court where your father lived and died.

How can I guarantee that all the assets my spouse inherited from our marriage go to our child and not to the new spouse if I die first?

That is a great question. You can specify in your will or trust that your spouse will get use of the assets when you pass away, but that after your spouse's passing, the assets will go to your child. In theory, your spouse can elect to take his spousal right of election of 1/3 of your estate, or $50,000, whichever is greater. You should speak to an estate planning attorney to discuss the best strategy forward.
